These Terms are a legally binding agreement between you and KHAN Family Holdings LLC, an Arizona company ("UnPlated," "we," "us," "our"), concerning your use of our website at unplated.app and the UnPlated app (together, the "Services"). By accessing or using the Services, you agree to these Terms. If you do not agree, you must not use the Services.
UnPlated is a subscription-based, AI-assisted food-decision tool that helps you choose dishes when dining out and modify recipes to fit your dietary goals and preferences. Features may change as we improve the product. The Services are provided from the United States and are not tailored to comply with industry-specific regulations such as HIPAA or GLBA.
You must be at least 18 years old to use the Services. You agree to provide accurate registration information, keep your password confidential, and are responsible for all activity under your account. We may suspend or terminate accounts that provide false information or violate these Terms.
The plan, price, and billing period are shown at checkout, and payments are processed by Stripe. Your subscription renews automatically at the then-current price each period until you cancel, and you authorize these recurring charges. If we offer a free trial, it converts to a paid subscription at the price shown when you signed up unless you cancel before it ends. You can cancel anytime from your account or by emailing hello@unplated.app; cancellation takes effect at the end of the current paid term. We may change subscription fees and will communicate changes in accordance with applicable law. All payments are in US dollars and applicable taxes may apply.
You can cancel at any time and will not be billed again, but payments already made for the current period are non-refundable except where required by law. If something went wrong, email us — we try to be fair.
You agree not to misuse the Services, including: using them for any unlawful purpose; reverse-engineering, scraping, or extracting our menu-decoding logic or outputs for competing purposes; interfering with or overloading the Services; uploading harmful code; collecting other users' data; or using the Services to build a competing product. We may suspend accounts that break these rules.
UnPlated's name, look, content, and marks belong to us and are protected by law; you are granted a limited, non-exclusive, non-transferable license to use the Services for your personal, non-commercial use. You keep ownership of what you submit (menus, recipes, preferences) and grant us permission to process it to provide the Services. Feedback or suggestions you send us may be used by us for any purpose without compensation to you.
If you use the app, we grant you a revocable, non-exclusive, non-transferable license to use it on devices you own or control, subject to these Terms and the applicable app store's terms. The Apple App Store and Google Play are third-party beneficiaries of this license.
The Services rely on and may link to third parties (such as Stripe and our AI provider). We are not responsible for third-party websites or content, and your use of them is at your own risk and governed by their terms.
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE MAKE NO WARRANTY ABOUT THE ACCURACY OR COMPLETENESS OF ANY SUGGESTION OR NUTRITION ESTIMATE, OR THAT THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE. YOUR USE OF THE SERVICES IS AT YOUR SOLE RISK.
TO THE FULLEST EXTENT PERMITTED BY LAW, UNPLATED AND ITS OWNER WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY FOOD, HEALTH, OR ALLERGY OUTCOME ARISING FROM YOUR USE OF THE SERVICES. OUR TOTAL LIABILITY WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE SIX (6) MONTHS BEFORE THE CLAIM, OR $100 USD, WHICHEVER IS GREATER. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.
You agree to defend, indemnify, and hold us harmless from any loss, liability, claim, or demand (including reasonable attorneys' fees) arising from your use of the Services, your breach of these Terms, or your violation of any law or third-party right.
These Terms are governed by the laws of the State of Arizona, without regard to conflict-of-law rules. The parties will first try to resolve any dispute through informal negotiation for at least thirty (30) days. If unresolved, disputes will be finally resolved by binding arbitration under the Commercial Arbitration Rules of the American Arbitration Association, seated in Maricopa County, Arizona; you waive the right to a jury trial and to participate in a class action. Claims must be brought within one (1) year. Claims for injunctive relief or intellectual-property protection are excepted from arbitration.
We may modify or discontinue the Services or update these Terms at any time; material changes will be posted here with a new date. We may suspend or terminate your access at our discretion, including for breach of these Terms.
